The recruitment of foreign labour has emerged as a prevalent necessity for numerous enterprises in Vietnam.

Since 18 September, 2023, the Government has issued Decree 70/2023/ND-CP, which includes numerous amendments and additions to the previous Decree 152/2020/ND-CP regarding regulations on foreigners working in Vietnam.

In fact, enterprises frequently make mistakes in the process of recruiting and managing foreign employees in Vietnam, such as:

  • Not understanding the regulations regarding the conditions for recruiting foreign labour;
  • Submitting incomplete applications for work permits for foreign employees or failing to comply with regulations;
  • Drafting labour contracts that do not include all mandatory contents as required by law;
  • Not registering social insurance for foreign employees as required by regulations and failing to fulfill the obligation to pay wages equivalent to the unemployment insurance contribution level for employees;
  • Applying the provisions of the Labour Code for Vietnamese employees to foreign employees, which can lead to violations of the rights of foreign employees;
  • Failing to renew work permits for foreign employees on time;
  • Failing to report the use of foreign employees in accordance with Vietnamese legal regulations;

This is not something any enterprise desires, but it often arises from a lack of understanding and effective application of labour laws in Vietnam, as well as failure to stay updated on new regulations regarding foreign employees in Vietnam.

To address these concerns, the first Legal Seminar was launched to the community with the theme “Foreign Labour Recruitment – Understanding, Notices, and Guideline”
