With the rapid growth of the economy and technology, protecting personal data and safeguarding business secrets or confidential information has become essential to safeguard the rights of individuals as employees, customers, consumers, and businesses.

Since its effectiveness on 1 July 2023, Decree 13/2023/ND-CP (hereinafter referred to as “Decree 13”) on personal data protection has introduced significant changes to business operations in Vietnam. Simultaneously, non-competition agreements play a crucial role in protecting a business’s competitive advantage and trade secrets.

In practice, many businesses still struggle to understand and apply Decree 13/2023/ND-CP and non-competition agreements, such as:

  • Incorrect application of the law when handling personal data: Businesses continue to apply the provisions of the Law on Information Security, the Law on Information Technology, and the Law on Electronic Transactions when processing employees’ personal data without updating to the latest regulations in Decree 13;
  • Misunderstanding of the regulations on non-competition agreements and personal data protection, leading to incorrect application of the law.
