During the course of employment, employers may assign employees to manage or use various types of company assets such as machinery, equipment, materials, or other assets serving production and business activities.
Chapter VIII of the 2019 Labour Code provides regulations on material liability, referring to the obligation of employees to compensate for damages when their actions cause loss or damage to the employer’s assets.
Material liability can also easily be confused with other types of legal responsibility such as labour discipline or compensation for damages under civil law. Clearly distinguishing the purpose and scope of application of each type of liability will help employers choose the appropriate handling method while minimising potential dispute risks.
When these regulations are properly understood and applied, employers not only have a legal basis to request compensation for damages when they arise, but can also enhance employees’ sense of responsibility and reduce risks and disputes related to assets within the employment relationship.
